1. Introduction

Welcome to www.idam.lk ("the Platform"). This Platform is owned and operated by Landhub (Pvt) Ltd, a company registered in Sri Lanka PV 00309761, with its principal place of business at No:351/A/19/B,Rosland Estate, Eheliyagoda ("the Company", "We", "Us", "Our").

These Terms and Conditions ("Terms") govern your access to and use of the Platform and its related services ("Service"). By accessing, browsing, or using our Service, you ("User", "You", "Your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use or access this Platform.

2. Description of Service

The Platform is an online marketplace that enables users to advertise, search for, find, buy, sell, and rent real estate properties in Sri Lanka. Landhub (Pvt) Ltd acts as a facilitator to connect property owners, developers, and agents with potential buyers and tenants.

Important: We are not a real estate broker, agent, or financial institution. We are not a party to any transaction or agreement that may occur between users of the Platform. We do not own, inspect, or verify the properties listed on our site. All contractual arrangements are solely between the seller/landlord and the buyer/tenant.

3. User Accounts and Registration

• Eligibility: To use certain features of the Service, you must be at least 18 years of age and have the legal capacity to enter into binding contracts under Sri Lankan law.
• Account Creation: You may need to register for an account to create listings or access certain features. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
• Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

4. User Conduct and Obligations

As a user of the Platform, you agree to:

• Provide true, accurate, and lawful information for your property listings, including descriptions, images, price, and location.
• Ensure you have the legal right and all necessary permissions to advertise the property you are listing.
• Comply with all applicable laws and regulations of Sri Lanka, including those related to real estate, advertising, and data privacy.
• Not use the Platform for any fraudulent, illegal, or malicious purpose.
• Not post any content that is defamatory, obscene, offensive, or infringes upon the intellectual property rights of any third party.
• Not engage in data mining, scraping, or using any automated means to access the Platform for any purpose without our express written permission.

We reserve the right to suspend or terminate your account and remove any listing without notice if you are found to be in breach of these obligations.

5. Listings and Content

• User-Generated Content: You are solely responsible for all content, including photos, videos, and text ("Content") that you upload, post, or otherwise transmit via the Service.
• License to Use Content: By posting Content on the Platform, you grant Landhub (Pvt) Ltd a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use, copy, display, distribute, and create derivative works from your Content in connection with the operation and promotion of the Platform.
• Content Moderation: We reserve the right, but not the obligation, to review, edit, or remove any Content or listing that, in our sole judgment, violates these Terms or is otherwise objectionable.

6. Fees and Payments

• Service Fees: Certain services, such as creating a listing or purchasing premium advertising packages, require payment of fees. All applicable fees will be clearly disclosed to you prior to you completing the purchase.
• Payment: You agree to pay all fees and applicable taxes incurred by you or anyone using an account registered to you. Payments must be made through the payment methods offered on the Platform, such as the Seylan Bank Payment Gateway.
• Changes to Fees: We may change our service fees from time to time. We will notify you of any fee changes by posting the changes on the Platform 14 days before they become effective.
• Refunds: All payments for services are subject to our Refund & Cancellation Policy, which is incorporated by reference into these Terms.

7. Intellectual Property

All content on this Platform, including text, graphics, logos, icons, images, software, and the compilation thereof, is the property of Landhub (Pvt) Ltd or its content suppliers and is protected by Sri Lankan and international copyright and trademark laws. You may not reproduce, modify, distribute, or republish any of the material from this Platform without our prior written consent.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Landhub (Pvt) Ltd disclaims all warranties, express or implied, in connection with the Service, including but not limited to:

• The accuracy, reliability, or completeness of any content or property listing on the Platform.
• The Platform being free of errors, viruses, or other harmful components.
• The conduct of any user of the Platform.
• The outcome of any transaction or negotiation entered into as a result of using the Service.

You expressly agree that your use of the Service is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Landhub (Pvt) Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any transaction or dispute between you and another user.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount of fees paid by you to Landhub (Pvt) Ltd in the 12 months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Landhub (Pvt) Ltd and its directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the competent courts of Colombo, Sri Lanka.

12. Changes to these Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
